Income Tax: Apart from maintaining the tax system in the country, the Income Tax Department (Income Tax rules) has many other responsibilities. In different cases, the Income Tax Department also seeks answers by sending notices to taxpayers (taxpayers' news). Many people are unaware of what to answer on receiving a notice from the Income Tax Department (income tax notice) and what action will be taken if they do not answer. Know the full details about this in the news.
The answer according to the question asked-
If you get a notice from the Income Tax Department, then instead of panicking, read it carefully and see what has been asked in it. According to this, every notice should be answered thoughtfully. Most of the notices are related to Income Tax Returns (ITR), if there is a notice for not filling it, then answer it properly.
Notice also comes regarding ITR-
If some flaw is found in the ITR (ITR filing rules) filed by the taxpayer, the department includes it in the wrong ITR. If the taxpayer does not provide the required information in the ITR or it is missed, then it is called Defective ITR.
In this situation, the Income Tax Department issues a notice under Section 139(9) of the Income Tax Notice Act asking to correct the mistake. It is necessary to respond to the notice after finding out the wrong ITR.
You will not get a tax refund -
Like other notices from the Income Tax Department, if you receive a notice on a wrong ITR, you have to respond within the stipulated time. In case of not responding, the Income Tax department can also take other actions. The disadvantage of filling a defective ITR will be that you will not get a refund of income tax. Apart from this, the ITR is also considered invalid by the department.
When is a defective return declared -
The department first marks the defective return filed by you. After that, a notice (Income Tax Notice) is sent. You need to know about defective returns, only then you will be able to answer it correctly. If any information is incomplete after filing tax, then the ITR will be considered defective.
You can also get a notice for claiming TDS (how to claim TDS) and not showing income for tax. When the Income Tax Department sees a difference between your income and the tax paid in your ITR (income tax return), then this ITR is defective.
How to respond to the notice of the Income Tax Department-
If the notice of the Income Tax Department comes under Section 139 (9) (Income Tax Notice rules) of the Income Tax Act, then it means that this ITR has come due to being defective. After receiving this notice, a reply has to be given within 15 days.
If for some reason you are not able to reply within the stipulated time, then you can also extend the time limit for replying by applying. You will have to apply for this to the Assessing Officer of the Income Tax Department.
